Prenuptial agreement

According to the Property Relations Law between Spouses in Israel, in the event of death or divorce, each spouse is entitled to half of the value of the joint property and assets accumulated during their marriage, according to the resource balancing arrangement.

If a married couple wishes for their property to be divided differently in the event of divorce, they must specify this explicitly in a property relations agreement.

Spouses can draft a property agreement before their marriage or during their marriage.

If the couple is not married but lives together, they can draft an agreement that regulates their economic relationship through a cohabitation agreement between common-law partners.

Drafting a property agreement can prevent prolonged and expensive legal disputes by establishing a clear and agreed-upon division of property in advance. This allows for a smooth separation process without economic conflicts, providing the couple with certainty and peace of mind during a sensitive period.

Drafting a property agreement as needed allows the couple to adapt the agreement to economic and familial changes that occur over the years. It is possible to draft the property agreement after the marriage, so it continues to suit the couple's evolving needs.
